Terms of Service
Last updated: 2026-10-19 (version c1a14c85)
These Terms of Service ("Terms") govern your use of Gamoty (the "Service"), provided via l2.smart123.ro by Smart Things Electronics SRL, Intr. Nicolae Iorga nr. 62E, Chiajna, jud. Ilfov, 077040, Romania (Trade Register J23/2073/2016, VAT ID RO36084428; telephone +49 174 5656609, e-mail [email protected]; "we", "us"). By creating an account or using the Service you agree to these Terms.
1. The Service
Gamoty is a remote-control and screen-streaming tool that lets you operate your own Windows PC from another device. You install our Windows client on the PC you want to control; you then access that PC through the Gamoty dashboard from a browser or a paired client.
The Service is in active development and is offered as a commercial beta. Features and availability may change with reasonable notice; prices change only as section 5 describes.
2. Account & eligibility
You must be at least 18 years old and able to enter into a binding contract. You are responsible for keeping your credentials secret and for all activity under your account. Notify us immediately if you suspect unauthorized access.
3. Acceptable use
You may only install Gamoty on computers you own or are authorized to operate. You agree not to:
- install the Service on devices you don't control;
- use the Service to surveil, harass, or defraud others;
- use the Service to violate any law applicable to you or to the PC being controlled (including the terms of service and fair-play rules of online games, or export regulations);
- reverse-engineer, resell, or redistribute the Service beyond what is expressly permitted;
- probe, scan, or disrupt the Service or its infrastructure.
We may suspend or terminate accounts that violate these rules.
4. Time passes & billing
A PC can be streamed to while it has time on it. Time is sold as subscriptions: each is for one PC and holds the number of months you choose when you buy it (1 to 12), paid for in advance, and the PC you put it on then renews for that many months each time its time runs out, until you delete its subscription (section 6). The price depends on how many PC-months you buy at once (PCs × months), not on which of your PCs they go on. Prices are listed on the pricing section in EUR and include VAT; section 5 explains them. If our payment processor shows you a price in your own currency, that is the amount you are charged, and refunds are made in that currency. Payments are processed by our payment processor, Stripe, Inc.
A subscription you buy waits in your account until you put it on one of your PCs, or on a friend’s PC shared with you (section 6); you choose which, and nothing puts it on a PC by itself. Until then it renews nothing and never runs out. Put on a PC that has no subscription, it subscribes that PC; put on one of your own PCs you already subscribe, it adds its months to that PC’s time, and that PC’s subscription stays as it is. Its months start when it is on a PC and run continuously from then on, whether or not the PC is used; months put on a PC that still has time start when that time runs out. A PC can hold at most 18 months of time ahead. Time passes bought before 30 September 2026 at 19:31 UTC were one-off months: they do not renew, and they stay yours to put on a PC; when your account has exactly one PC with no time left, a waiting one goes on that PC by itself.
14-day right of withdrawal. You may withdraw from a purchase, or from subscribing a PC, within 14 days of making it, to the end of the 14th day — with the “Withdraw from contract here” button in your dashboard, in “Time passes & billing” — next to the subscription, or under “Recent purchases” for a purchase — by deleting the subscription there, or by e-mail to [email protected]. You then pay only for the time used until you told us, in proportion to the total price you paid, and we refund the rest; the time that purchase or subscription paid for ends when you withdraw, and any other time on your PCs is untouched. If you withdraw from only part of what one payment paid for — one PC’s subscription, while other PCs or months paid in the same payment stay — what you keep (those, and the time used) is priced on the price list as that many PC-months, and the rest of that payment is refunded. We confirm the withdrawal by e-mail, with the date and time we received it. Withdrawing from a purchase that started a subscription ends that subscription too, and the subscriptions of the PCs on free time whose days it paid for; what they charged since is refunded for its unused part. Time bought separately stays yours. A renewal of a subscription, of one month or of several, continues the same contract and does not start a new 14 days. Cancelling in the billing portal is not a withdrawal: it only stops the next renewal (section 6); to withdraw, use the withdrawal button, delete the subscription, or e-mail us. The Refund Policy gives the details.
A PC with no time stays paired and visible in your dashboard. It cannot be streamed to until time is added.
5. Prices and the launch offer
Regular price. The regular price of the Service is €9.99 per PC per month, VAT included.
Launch offer. While the Service is new, we sell it at a promotional launch price: €2.99 per PC per month, and less for each PC-month when more PC-months are bought or renewed together, as shown on the price list. The launch price is a promotion, not the regular price. It applies to every purchase and renewal payment made while the offer runs, and we will announce on our website when it ends.
Why prices may change. We may change our prices in the future, for example when the cost of the servers and network that carry your streams changes, when taxes change, or when we change or extend what the Service offers. A new price applies only to payments made after it takes effect.
What a price change never does.
- It never changes the price of time you have already paid for: every day you bought stays on your PC.
- It never changes a renewal without warning: we e-mail you at least 30 days before a new price applies to your renewal payments. Until then you can delete any subscription from your dashboard, free of charge, and your PCs keep the time already paid for. If you keep a subscription, the payments after that date are charged at the new price.
Taxes. Our prices include VAT. If the VAT rate that applies to you changes, the price including VAT may change by the same amount, with the same 30 days’ notice for renewal payments.
6. Subscriptions
You subscribe a PC by putting on it a subscription you bought (section 4), or from its row in your dashboard, and confirm it there. A subscription you bought is subscribed under the words you agreed to when you bought it, and its 14 days to withdraw run from that purchase. If you confirm anything on its PC’s row before it starts — the days it pays to your subscription date, or finishing it there — that confirmation subscribes the PC from its row: what the subscription charges from then on can be withdrawn from within 14 days of that confirmation. The months you bought stay part of that subscription and keep the purchase’s 14 days. A subscribed PC renews, each time its time runs out, for the months its subscription renews for — the months you bought it with, or one month for a PC you subscribe from its row — until you delete its subscription. You can change those months (1 to 12) from the PC’s row; the change applies from its next renewal, and the months already paid stay as they are. All the PCs of your account are on one subscription with one monthly date, charged with the card saved on your account — or, if you chose in your dashboard to pay by invoice, invoiced by our payment processor 7 days before each date, due on that date and paid by card or bank transfer on the invoice page; no card is kept for it. The way you pay can be changed while no PC of yours is subscribed. The dashboard shows every amount and date before you confirm.
Your first subscription. Subscribing a PC that still has time (for example during its free trial) charges nothing that day: if we do not have your card yet, you add it on our payment processor's page, where nothing is charged, and the subscription's date is the moment that PC's current time runs out, when it is first charged. Subscribing a PC that has no time left charges its first month straight away, and that day becomes the subscription's date; when it is one of your own PCs, any other PC of yours still on free time (its free trial, or time we gave it) that runs out before the subscription first renews, and that nobody else pays for or has asked to, is subscribed with it, and pays straight away the days from the end of that free time to that renewal, at the price that PC adds to the subscription.
The subscription follows the same price list as a purchase. On each subscription date the PCs whose time would otherwise run out before the next one are charged, each for its own months, and together those PC-months cost what that many months cost on the price list: the more PC-months are charged together, the less each one costs. Each PC’s months take their places on the list after those of the PCs subscribed before it that are charged on the same date, so a PC never costs more than it would alone. A PC whose time is already paid for is not charged on that date, so the amount can differ from one date to the next. We e-mail you 7 days before a renewal whose amount differs from the previous one, and before every renewal of 6 months or more — or at once, when a change made later (a PC added, a subscription put on a PC, its months changed) makes it differ — so that you can delete or change a PC’s subscription before it is charged. The e-mail states what your card is charged, with any amount carried from an earlier payment or any credit on your account. If you pay by invoice, the invoice our payment processor sends 7 days before each date is that notice.
Adding a PC. When you subscribe another PC, you pay straight away for the days from the moment its current time runs out (or from now, if it has none) to the subscription's next date, at the price that PC adds to the subscription. That payment also carries any amount an earlier payment added to it, less any credit on your account, and the dashboard shows what it comes to before you confirm. If it comes to less than €0.50, it is added to your next payment instead — your next renewal payment, or the next PC you add, whichever comes first — and shown there before you confirm. A PC with no time left is the exception: it is subscribed only by a payment made at once — its days charged to your card, at least €0.50, or paid in full by credit on your account — so when, close to the subscription's date, its days come to less, it is not added to your next payment: subscribe it once that date's renewal has gone through, or put a subscription you buy on it. From that date the PC is charged with the others, and the price of the whole subscription is recalculated on the price list. A PC whose time runs out less than an hour after a subscription date that has not come yet has no days to pay: that date's renewal, which is charged about an hour after it, charges it then, with the others — so subscriptions put within the same hour on PCs with no time left renew together. Put on at other times, or on a PC that still has time, they may renew on dates of their own, each priced with what renews on its own date. The subscription's date never changes. If you pay by invoice, those days are invoiced instead of charged, due within 7 days and before the subscription's date, and the PC is subscribed when the invoice is paid.
Deleting a subscription. You can delete a PC's subscription at any time from your dashboard: Cancel a subscription, at the top of it, shows every PC with its “Delete subscription”. Nothing more is charged for that PC (a renewal of it already being charged when you delete it is refunded); the month in progress runs to its end and is not refunded, and every whole month this subscription paid for in advance — the months you bought it with, if you bought it, its renewals (the months of a renewal of several months that have not started included), and months you bought for the PC after subscribing — is refunded at the price-list rate of the months you keep (you pay the list price of the time you keep), to your card — or, for any part that was not paid by your card when it was charged (paid from credit on your account, or a charge under €0.50 carried to your next payment), as credit on your account. Other months you bought before subscribing are a purchase of their own (section 4), even when you put them on the PC later: deleting the subscription does not refund them. Within 14 days of subscribing, deleting is a withdrawal (section 4): the time the subscription paid for ends at once — the PC stops then unless it holds other time — and the unused part of any month the subscription has charged is refunded too. The price of the rest of the subscription is recalculated on the price list; its date does not change. Removing a PC from your account, or replacing it, does not end its subscription. If its time is still running and your account has exactly one other PC with no time, or you pair a new one, that PC takes it with its subscription at once. Otherwise it waits, on no PC, until you put it on one of your PCs from your dashboard, and nothing is charged for it meanwhile: the time it had already paid for keeps running, and a renewal taken just as the PC was removed is refunded. If its time ran out, putting it on a PC joins that PC to your subscription as in “Adding a PC”, with the amount shown before you confirm. If someone else pays the PC’s subscription, it goes back to them instead (“Paying for someone else’s PC”, below). A subscription ends only when you delete it (the months it paid for in advance are then refunded), cancel it, or as this section says for a renewal left unpaid, a chargeback or a deleted account. The billing portal linked from your dashboard cancels the whole subscription at the end of the current period: nothing is renewed, nothing is refunded, and every PC keeps the time already paid for.
If a payment fails, or an invoice is not paid by its date, the PCs it was for stay usable for up to 48 hours so you can update your card or pay the invoice. If it is not paid within those 48 hours, the subscription of those PCs ends: the payment is cancelled (an unpaid invoice is cancelled by a credit note), nothing is owed for it, and you can subscribe them again at any time (the free trial is not offered again).
If a payment to us is disputed with your bank (a chargeback), every subscription on your account ends at once: nothing more is charged, the time that payment bought is taken back while the dispute is open, and the rest of the time already paid for keeps running. If the dispute is decided in our favour, that time is given back; the subscriptions do not restart by themselves, and you can subscribe again at any time.
Paying for someone else’s PC.
- You can pay the subscription of a friend’s PC: one they shared with you, from your list of PCs — by subscribing it there, or by putting on it a subscription you bought — or by sending a subscription to their e-mail address. Only a PC with no paid time of its own (none, or only free time) and no subscription can be paid for by someone else.
- The subscription is yours: it is on your monthly bill and priced like your other PCs on the price list. You can delete it at any time (the months it paid for in advance are refunded to you), and every refund goes to you. Your friend pays nothing and cannot change it.
- A subscription you send needs a monthly bill of yours that renews. Your friend has 30 days to put it on one of their PCs, or to decline it, from when it reaches their account; someone without an account first has 30 days to create one with the address you sent it to and confirm that address. Nothing is charged before, and until then you can cancel it for free. When they put it on a PC you are charged the days from then (or from the end of that PC’s free time, if it still has some) until your bill date — on a PC with no time left, only when those days can be charged at once, as in “Adding a PC”. It is placed only at the price you were shown when you sent it, or less: if one more PC costs you more by then, or your bill no longer renews, nothing is charged, we tell you, and you can cancel it and send a new one. Once it is on a PC, your monthly bill follows the price list for all the PCs on it, as for your own. Your 14 days to withdraw start when it is on a PC.
- Your friend is told when you start, renew or stop paying, and when a renewal could not be taken — never with any amount. If they stop sharing their PC with you, the subscription goes on and you are told.
- They can give it back. Nothing is refunded by their doing so: it comes back to you, on no PC. Their PC keeps the time already running, and any time paid in advance comes back with the subscription and waits for you. You then put it on one of your PCs, or on a PC shared with you that has no paid time of its own (none, or only free time) — either joins your bill by paying its own days until your bill date — or delete it, and either way that time paid in advance is refunded to you. Within your 14 days you can still withdraw: you pay only for the time used, and the time still running on their PC stops.
- Every PC you pay for is in your list of PCs, and you can take the subscription off it at any time: it comes back to you the same way, and your friend is told.
- If your friend removes the PC it is on, or deletes their account, it comes back to you the same way: the time already running stays with them, and any time paid in advance comes back with the subscription. Only you can put it on another PC. One you sent that they never placed ends if they delete their account, with nothing charged.
- If you delete your account, it ends and your friend keeps the time already paid, including any months paid in advance, which are not refunded to you.
Price changes follow section 5: we e-mail you at least 30 days before a new price applies to your subscription payments, and you can delete any subscription before then. See our Refund Policy for refunds.
7. Free trial
A new account's first PC gets 15 days free when it is paired. No payment card is needed. The trial never turns into a paid plan by itself: when it ends, the PC stops until you add time. The trial is offered once per account and once per computer, and not to an account that has already bought time, nor to an account or a computer that has already had a trial or a grant of time. We may decline it where it has already been used, including through another account.
8. Intellectual property
The Service, including the client software, server code, website, and branding, is owned by us and our licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose while your account is active. No other rights are granted.
9. Availability & support
We make reasonable efforts to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Support is provided at [email protected].
10. Disclaimer
Your statutory rights. Nothing in these Terms limits your statutory rights as a consumer, including the legal guarantee of conformity for digital services (Directive (EU) 2019/770, in Romania Government Emergency Ordinance 141/2021); sections 10 and 11 apply only as far as those rights allow.
Beyond those rights, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose or non-infringement. You use the Service at your own risk. In particular, Gamoty must only be used on PCs you are authorized to operate.
11. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the Service is limited to the amounts you paid us in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill.
12. Termination
You may stop using the Service at any time. To have your account and its personal data deleted, email [email protected] from your account address; we first delete every subscription (section 6) and refund every month you paid for that has not started — bought outright or through a subscription — and, within 14 days of subscribing, the unused part of the current month; time already started ends with the account. A subscription you pay for a friend’s PC ends without a refund, and your friend keeps the time already paid (section 6). We may suspend or terminate your access for breach of these Terms, for non-payment, or where required by law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, governing law) will survive.
13. Changes
We may update these Terms from time to time. If changes are material, we e-mail you at least 30 days before they take effect. If you do not accept them, you can delete your subscriptions before then, free of charge, and the months those subscriptions paid for in advance are refunded; time you have already bought is never shortened by a change.
14. Governing law
These Terms are governed by the laws of Romania, without regard to conflict-of-law rules. Disputes will be handled by the competent courts of Bucharest, Romania, unless a mandatory consumer-protection rule in your country of residence says otherwise.
Out-of-court resolution. If we cannot settle a complaint with you, you can turn to the Romanian National Authority for Consumer Protection (ANPC, anpc.ro) and its alternative dispute resolution service (SAL), or to the consumer authority of your country of residence.
